The bill strengthens protections for minors, sets a minimum age of 16 for granting consent to use one’s own image, and restricts the reuse of AI-generated images and voices without authorization.
“The fact that people share personal or family images on social media does not grant absolute freedom to use those images in other contexts,” said Spain’s Minister of Justice, Félix Bolaños.
The reform also directly addresses artificial intelligence, deeming it illegal to use a person’s AI-generated image or voice for advertising or commercial purposes without their consent.
Bolaños noted that creative, satirical, or fictional uses involving public figures will be permitted, provided that such content is clearly identified as AI-generated.
The draft bill must still undergo a consultation process before returning to the government for final approval and subsequent submission to Parliament.
This legislative initiative comes amid increased scrutiny of AI tools, including the Grok chatbot by xAI, Elon Musk’s company, which is currently under investigation.
