Elon Musk’s lawsuit against OpenAI and its CEO Sam Altman is set to proceed to court. A federal judge in California said on Wednesday that she intends to reject efforts by Altman’s lawyers to have the case dismissed. “There is ample evidence,” Judge Yvonne Gonzalez Rogers said during a hearing in Oakland
Musk accuses OpenAI of misleading him about its transition from a nonprofit organization to a for-profit structure. He says he donated a total of $38 million to the company. The trial is scheduled to take place in March. OpenAI denies the allegations, calling the lawsuit “baseless” and part of an “ongoing campaign of harassment” by Musk.
The company maintains that Musk was already aware of the plans to pursue a for-profit model as early as 2018. Musk co-founded OpenAI in 2015 and left the organization in 2018.
