According to AI Wire Media, citing TASS, the new regulation requires owners of artificial intelligence (AI) systems to label all AI-generated content, including images, videos, audio recordings, texts, and other materials. The law also restricts the operation of certain neural networks in Kazakhstan and regulates copyright issues related to AI.
Under the law, the distribution of AI-generated content is permitted only if it is labeled in a machine-readable format and accompanied by a visual or other form of warning that can be clearly perceived by users, without using methods that would hinder such perception.
The Ministry of Artificial Intelligence and Digital Development of Kazakhstan previously emphasized that responsibility lies with the owners of AI systems, not individual users. Oversight will not involve mass проверки of every image or video, but rather regulatory supervision of AI system owners. The authorized AI body will respond to complaints, reports, monitoring results of public resources, and official distribution channels. The focus is not on whether an individual used AI, but on whether the system owner allowed the distribution of synthetic content without the legally required labeling.
Penalties for violations will apply to AI system owners. In 2026, fines will range from $127 for individuals to $845 for large businesses.
Kazakhstan’s Center for Combating Disinformation, established last year within the Central Communications Service under the President, has repeatedly debunked false information following the spread of AI-generated videos online. A sharp rise in fake content in Kazakhstan’s digital space was recorded in October last year, after users gained access to Sora 2, OpenAI’s realistic video generation model. This week, the Center urged media outlets, bloggers, and digital platform administrators to take a responsible approach to AI technology and “start with themselves” by being transparent with audiences about content created using AI.
In addition to mandatory labeling, the new law addresses copyright: creative works are protected only if a human participated in their creation. At the same time, a text prompt used to generate content with a neural network can itself qualify as an object of copyright protection.
